Mongolia Property Ownership Law Is Relatively Open and Transparent

The regulatory framework for title and property rights in Mongolia appears relatively lenient and with one of the best tax policies in Asia makes Mongolia attractive for property ownership.


Property ownership rights exercised by foreign investors are identical to the Mongolian citizens’ rights. There is no discrimination against foreign ownership.



All land in Mongolia is owned by the state.


Freehold Land in Mongolia


However, in reality all property developed are considered freehold in nature and can be transacted freely. The title deed or a lease is termed as ‘Immovable Property Ownership Certificate’. The law prohibits neither the Government nor any other legislative body to evict owners (foreign or domestic) or confiscate property with Immovable Property Ownership Certificates.

Sales Tax (Stamp Duties)


A sales tax on immovable property and land (stamp duty) is 2% of the sales price value of the property. There is no capital gains tax levied on immovable property sales in Mongolia and also no annual property tax for residential properties.


Furthermore, there are no currency controls. Foreign investors can repatriate profits out of Mongolia freely. The local currency is also fully convertible to major currencies marked to market.
